Judges in Texas and New York bar US use of Alien Enemies Act to deport Venezuelans

The pair of decisions did not approach the legality of the Law of Use of President Donald Trump of the Alien Enemies Law to deport Venezuelans accused of belonging to the Trena de Aragua gang, and only asked immigrants in federal districts of custody.

Judge Fernando Rodríguez Jr. signed a temporary restriction order in the morning that applies to the people locked in the El Valle detention center in Raymondville, Texas. Judge Alvin K. Hellerstein signed a similar order in New York early in the afternoon that is applied throughout the Southern District of New York, which includes the districts of New York City of Manhattan and Bronx, and six counties north of the city.

In Texas, the three plaintiffs include an HIV positive man and fears losing access to medical care if he is sported.

Law of the law of the alien enemies disputed

The judicial movements were the first to occur after the United States Supreme Court ruled on Monday that the administration can resume deportations under the law, but deportees must have some due process before they are transferred, include the time that can be seen with deported.

The civil rights lawyers in the two states had sued to prevent the government from deporting five men who deny being part of the Trena de Aragua gang.

It is likely that similar legal challenges continue in other places where Venezuelans have been arrested. The American Union of Civil Liberties is asking the judges in Texas and New York to decide whether the use of the administration of the Alien Enemies Law is legal when the country is not at war.

The Law of Alien Enemies has only used the leg three times in the past, the duration of the War of 1812, World War I and World War II, when used to justify the massive internment of people in Japanese inheritance while the United States at war with Japan.

The United States is not at war with Venezuela, but Trump has argued that the United States is invaded by members of the Trena de Aragua gang.

The United States immigration authorities have already deported more than 100 people and have sent them to a notorious prison in El Salvador without letting their removals challenge in the Court.
